Terms of Use

These Terms of Use govern your use of the Side Quest mobile application (the "App"), operated by TUSC Studio. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App. Questions can be sent to contact@sidequestcorp.com.

Acceptance and eligibility

You must be at least 17 years old to use the App. You represent that you meet this requirement and that you are able to form a binding contract with us.

Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@sidequestcorp.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

The service

Side Quest delivers daily dares and challenges ("Quests"). You complete a Quest, upload photo or video proof, receive an automated AI verification result, and earn points toward streaks, squads, and leaderboards. Features, Quests, point values, and rules may change at any time.

Assumption of risk and your responsibility for Quests

Quests are performed at your own risk. Side Quest is a fun, dare focused social game. Quests may involve mild public stunts, physical activity, social interaction, or going to public places. You are solely responsible for deciding whether to attempt any Quest and how you carry it out.

• You will only attempt Quests you can perform safely and legally.
• You will obey all applicable laws, regulations, property rules, and the rights of others while completing any Quest.
• You will not attempt any Quest that could endanger you or anyone else, involve trespassing, harassment, property damage, illegal activity, or harm to any person, animal, or property.
• You will not pressure or dare others to perform unsafe or unlawful acts.
• You are responsible for obtaining any consent needed to photograph or record other people and for respecting their privacy.

We do not review Quests for safety in advance and do not supervise how you complete them. You voluntarily assume all risks associated with participating in Quests, including risk of injury, loss, legal consequences, or harm to yourself or others. To the fullest extent permitted by law, you release Side Quest from any claims, liabilities, damages, or expenses arising out of or related to your participation in any Quest.

User content and license

You retain ownership of the Submissions and other content you upload. By uploading content, you grant Side Quest a worldwide, non-exclusive, royalty free, transferable, sublicensable license to host, store, reproduce, modify for formatting and display, process (including by AI providers), display, distribute, and otherwise use your content to operate, promote, and improve the App and its features.

You represent and warrant that you own or have all rights necessary to your content, that it does not infringe or violate the rights of any third party, and that it complies with these Terms.

Prohibited conduct and content

You agree not to upload, post, or share content, or use the App, in any way that:

• Is illegal, fraudulent, or promotes illegal activity.
• Depicts or encourages dangerous, harmful, or unlawful acts.
• Is sexually explicit, involves nudity, or sexualizes any person.
• Depicts or involves minors in any unsafe, sexual, or exploitative manner.
• Is harassing, bullying, threatening, hateful, or defamatory.
• Contains violence, gore, or content that promotes self harm.
• Violates the privacy or intellectual property rights of others.
• Attempts to cheat, game, spoof, or manipulate quest verification, points, streaks, or leaderboards.
• Uses bots, scraping, reverse engineering, or attempts to disrupt or gain unauthorized access to the App.
• Impersonates any person or misrepresents your affiliation.

We may remove content, restrict features, and suspend or terminate accounts that violate these rules, at our discretion.

Content moderation

We use a combination of automated systems (including AI) and, where appropriate, human review to moderate content and enforce these Terms. We do not guarantee that all prohibited content will be detected or removed, and we are not responsible for user content. You can report content or users through the App or by contacting contact@sidequestcorp.com.

Subscriptions, purchases, and virtual items

Side Quest offers a free ad supported tier, a premium subscription (ad free with expanded Quest decks), and skip token microtransactions. New users receive a limited number of free skip tokens. Purchases and subscriptions are processed through the applicable app store and our billing provider. Subscriptions renew automatically until cancelled, and you can manage or cancel through your app store account settings.

Except where required by law or app store policy, all purchases are final and non-refundable. Points, streaks, skip tokens, and other virtual items have no cash value, are not transferable, and may be modified, revoked, or discontinued at any time.

Advertising

The free tier is supported by advertising. We are not responsible for the content of third party ads or for any products or services advertised. Interactions with advertisers are solely between you and the advertiser.

Intellectual property

The App, including its software, design, branding, logos, and content we provide, is owned by Side Quest or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Third party services

The App relies on and integrates third party services, including Anthropic, Supabase, RevenueCat, Expo, Apple, Google, and advertising and analytics providers. Your use of those services may be subject to their own terms and policies. We are not responsible for third party services or their acts or omissions.

Disclaimers

To the fullest extent permitted by law, the App and all content, Quests, and AI verification results are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We do not warrant that the App will be uninterrupted, secure, or error free, or that AI verification or moderation will be accurate.

Limitation of liability

To the fullest extent permitted by law, Side Quest and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, personal injury, or property damage, arising out of or related to your use of the App, your participation in any Quest, any user content, or any automated or AI decision, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or twenty five US dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Side Quest and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the App, your participation in any Quest, your content, your violation of these Terms, or your violation of any law or the rights of any third party.

Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination, including content licenses granted before termination, disclaimers, limitation of liability, and indemnification, will survive.

Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you may have under mandatory consumer protection laws of your place of residence.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means and update the "Last updated" date. Your continued use of the App after changes take effect means you accept the updated Terms.
